An invaluable resource for Federal Courts

All of the thousands of law school study guides tout themselves as a means of breaking down the often complex material for students. Unfortunately, however, few are able to accomplish that goal, as the study guides themselves are often almost as large as the casebooks and do little to demystify law school courses. Chemerinsky's text is a refreshing change, as his Federal Jurisdiction hornbook helps you understand what is universally seen as the hardest course in law school, Federal Courts.
Federal Courts is such a difficult class because of the sheer complexity of the material. Sadly, many students, me included, are forced to use Hart and Wechsler's Federal Courts casebook which is itself very difficult to learn from (for reasons I discuss in my review of that book). Many casebooks try to go over too much: they spend time on general principles, certainly, but often get caught up in discussing every single case with some relevance to the course, with less focus on hammering down an understanding of the general principles. Hart and Wechsler is a prime example of this. Their casebook is difficult to digest because there is so much to learn. Their endnotes are filled to the brim with hundreds of cases, many of which are unnecessary to obtain a general understanding of the course. And let's be honest, while these cases might be vital for aspiring future clerks taking Federal Courts, not all of us are clerking for the D.C. Circuit anytime soon.
Chemerinsky's hornbook very adequately solves this problem. Of all of the study guides and hornbooks I have perused in law school, Chemerinsky's book helped guide me the most, in what is the hardest class I have taken. In well-defined sections, Chemerinsky breaks down the daunting Federal Courts in a manner that is easy to read and ultimately understand. Chemerinsky clearly as well as concisely lays out a framework for each of the key bedrock principles of Federal Courts and federal jurisdiction without getting caught up in going over every possible case with implications for federal courts. Chemerinsky does discuss the key exceptions as well as minor cases, but they flow very well with his general discussions of the base material of Federal Courts. His book, therefore, was extremely easy to absorb and helped me immensely in understanding Federal Courts.
I was often bewildered and perplexed by the material discussed in Hart and Wechsler and in class lectures. Chemerinsky's book tore down much of my confusion by helping me focus on the key concepts of Federal Courts, and not getting lost in the forest of cases delineated by the casebook and by my professor. I strongly recommend that any student taking Federal Courts buy this book. It is invaluable to learning the course. You would be doing yourself a disservice if you did not take a look at Chemerinsky.

amazing study aid for federal courts

I'm a third year law student currently taking federal courts with an amazing professor. However, this book gives a thorough, unbiased analysis of this extremely complicated and often unsettled area of the law. I usually recommend the "Example & Explanations" series for a helpful guide to actually understanding material; however, Chemerinsky is able to give an easy to read, comprehensive analysis of the federal court system, including justiciability, Congressional control of Federal and State court jurisdiction, Congressional power to create legislative courts under Art. I, federal subject matter jurisdiction of the federal courts, federal common law, federal relief against federal officers (Bivens actions), suits against state governments, the 11th amendment, federal court relief against local governments and state/local officers under 28 USC 1983, federal court review of state court decisions, the Anti-Injunction Act, federal abstention, and habeas corpus.

This book is not for the introductory class in federal procedure that most law students take first year (for that I highly recommend Freer's book Acing Civil Procedure, and the Examples & Explanations series on Federal Civil Procedure). However, every law student and practicing attorney should have a copy of this book! Really helps tie all these complicated topics together.

The only downside to the 4th edition (I have the book from 2001) is that it doesn't have a good analysis of CAFA, MMTJA, or general res judicata and collateral estoppel issues. But this book is absolutely amazing! I wish every law topic had a resource this helpful and reliable.

Helping you through Fed. Courts

This book was a great help to me getting through Federal Courts in addition to my textbook. As any law student can tell you, Federal Courts or Federal Jurisdiction probably outranks civil procedure as the most dreaded class at law school. I am a firm believer in the importance of the subject and this book was invaluable to me in class and in work. If you have a legal problem that will involve federal litigation, this book is a must have. It makes a subject that I often believe is as clear as reading tea leaves a little easier.

A life of the Essays

This is not so much a biography of Michel de Montaigne as it is a biography of his book ... which is a legitimate approach since Montaigne himself described the Essays as a portrait of himself, a model of the author in text form. So, Ms. Bakewell has given us many facts about Montaigne's life as well as chronicling the fortunes of the Essays during his life as well as the endless revisions and re-interpretations that occurred after his death. The story is told in true Montaignian fashion, out of chronological order and with numerous digressions, with chapter headings that consist of twenty hypothetical answers to the book's central question: "How to live?" Unlike Montaigne, the content of each chapter stays (mostly) relevant to the subject in its heading. The back of the book contains a brief timeline, an index, and a list of notes. (Strangely these numbered notes are not indicated in the text, making them essentially useless; but that may just be an idiosyncrasy of the Uncorrected Proof copy which I read.)

I first discovered Montaigne when I happened upon the Essays in the History section of the bookstore. I knew nothing about him, but the dust-jacket blurb described him as the inventor of the essay, literature's first "modern" writer, an affable gentleman who good-naturedly natters on at length about any topic that catches his fancy (his favorite subject being himself). His mind wanders and his pen follows it wherever it happens to go. I bought the book, expecting nothing more than to be entertained, and was amazed to discover how emotionally uplifting it was. Montaigne apparently did not wish to consider himself a "philosopher" yet that's what he seemed to be. Here's an educated, well-read guy with an agreeable, easygoing manner .. completely scatterbrained and yet so WISE .. he seemed to have come to grips with his own mortality and figured out all of life's Big Questions, over 400 years ago. I was impressed. I found him to be intensely relevant and overflowing with thoughts and opinions that made So Much Sense, they perfectly matched my own.

Now Ms. Bakewell's book makes it clear that my Montaigne experience is typical. Many of the great and not-so-great minds of Western civilization (since 1580) have read the Essays and gotten the eerie impression that it was written specifically for them. Many of these stories are told briefly in the book, but the biggest section is devoted to Pascal and Descartes who were strongly influenced in a _negative_ way by Montaigne. Much of their most memorable work was a reaction against him. It's truly the mark of a classic when a book continues to be so influential centuries after the author's death.

_How to Live_ is not "necessary" reading by any means (you can get full enjoyment from the Essays without knowing any of this background information) but it does add some value by shedding light on the collective experience of people reading and reacting to the Essays throughout history. More Than Just a Biography

You've heard of hybrid cars? Get ready for the hybrid biography. Sarah Bakewell's luminous HOW TO LIVE is just that -- an inspired collision of biography, philosophy, history, rhetoric, and literary criticism, all sprinkled with a dollop of self-help. That's right, Bakewell shows how seamlessly Michel Eyquem de Montaigne can enter the 21st century and offer advice to the harried reader. Montaigne, after all, was anything BUT harried. Calm, cool, collected, stoic. That was our man in France.

Now most readers undertake a biography because they are interested in the subject. I was more intrigued by the critical buzz Bakewell's book garnered in the press. And so it was that I got to know Montaigne, famous author of the ESSAYS, through Bakewell's unique design of 20 chapters all based on the question "How to Live?" with a different answer. They are, in order, "Don't Worry About Death," "Pay Attention," "Be Born" (Editor's Note: Very funny), "Read A Lot, Forget Most of What You Read, and Be Slow-Witted," "Survive Love and Loss," "Use Little Tricks," "Question Everything," "Keep a Private Room Behind the Shop," "Be Convivial: Live With Others," "Wake From the Sleep of Habit," "Live Temperately," "Do Something No One Has Done Before," "Do a Good Job, But Not TOO Good a Job," "Philosophize Only by Accident," "Reflect on Everything; Regret Nothing," "Be Ordinary and Imperfect" (Editor's Note: Easy!), "Give Up Control," and "Let Life Be Its Own Answer." If those topics intrigue you in any way, so will this book.

What did I learn? Of course, as expected, a lot about Montaigne's life as that is the main thread. The bonuses for me were things like short but essential lessons in philosophies that influenced Montaigne (Stoics, Epicureans, Skeptics) and in personalities that he in turn influenced or outraged (Pascal, Rousseau, Voltaire, Nietzsche, etc.). Also, there was the history lesson on 16th-century France's religious wars (Catholics v. Protestants). Bloody good. And then there were all the snippets from Montaigne's essays themselves. Some readers may want to read more by tackling the behemoth ESSAYS after this book. Others may feel that this sampler is sufficient unto itself -- after all, you come out more knowledgeable about the man, his approach toward life, his writing style, and even his translators.

Overall, it's an unusually refreshing run at what should have been staidly-boring material. Bakewell's theme is that Montaigne is more interesting and timeless than you think. Her hybrid biography proves the point by meeting the same criteria. If you have any interest in the past, essay-writing, philosophy, religion, politics, and the common man as championed by a most unusual man, HOW TO LIVE is your book.

The 16th Century is Closer Than We Thought

Sarah Bakewell's book on Michel Eyquem de Montaigne (1533-1592) is worthwhile in large part because Montaigne is not as widely read as he deserves to be; her work may help redress that situation. Wisely, she gives readers to understand that they may see themselves in Montaigne's Essays: She understands the narcissism that pervades our culture. It is fascinating - and rather suggestive - that so many people claim to see themselves in the writings of a thoroughgoing skeptic.

Her theme is "how to live" - a subject on which Montaigne is full of insights, though he never presumes to offer advice. In 20 chapters, Ms. Bakewell explores approaches to life derived from Montaigne, such as "Be ordinary and imperfect," "See the world," "Guard your humanity," "Wake from the sleep of habit," "Let life be its own answer," and perhaps most characteristically for Montaigne, "Question everything." If this smacks of the self-help book, don't be deceived. Montaigne is talking about his life, not yours. If you look in his Essays for tips on living, you will not be alone, though his purpose is to describe, not prescribe.

I will not attempt a discussion of Montaigne's Essays here. They have been well reviewed elsewhere. Suffice it to say that he was a learned and yet highly sympathetic member of the French nobility and man of affairs who gave up his public life and duties to think, read, and write. He is the author of insightful, often delightful, essays on all kinds of things - even cannibals.

Ms. Bakewell is more than a casual student of Montaigne and her lively study is more than just a history of his collection of essays. She offers a clear-eyed though necessarily incomplete view of Montaigne's personality, to the extent it can be made out from this remove. She also spends substantial time on Montaigne's experiences with death, for instance, and this may be valuable to modern readers, many of whom, I suspect, would just as soon avoid that subject altogether. Ms. Bakewell brushes in some of the intellectual, historical, religious, and political background and context with which Montaigne was familiar, as by commenting on Stoicism, Epicureanism and Skepticism, e.g. The reader thereby gets a better understanding of the skeptical tradition to which Montaigne was a major contributor. Finally, there are numerous useful and interesting illustrations, even if they are not generally of the best quality. There's even a picture of a bottle of wine made at the estates near Bordeaux over which Montaigne presided. Oenophiles will note the connection between Chateau d' Yquem, where a spectacular sweet wine is made, and a branch of Montaigne's family from which one of his names originated: Eyquem.

I had hoped for a more substantial discussion of Montaigne's longest and perhaps most important essay, "A Defense of Raymond Sebond," also called "An Apology for Raymond Sebond." It is a somewhat confusing piece for a lay reader to confront. Ms. Bakewell gives it short shrift. And although she relies exclusively on the Frame translation, which is excellent, as long as she was preparing a book on Montaigne for the modern reader, she might have commented on other translations, such as the Screech translation, to give us an idea of their respective strengths and weaknesses. (N.B: I find that Gore Vidal wrote an excellent essay on Montaigne and briefly compared the Frame and Screech translations. The essay was originally published in the Times Literary Supplement of June 26, 1992. It has been reprinted in The Selected Essays of Gore Vidal, Jay Parini, Ed., Vintage paperback 2009.)

I do disagree with another reviewer's somewhat breezy conclusion that Montaigne is "scatter-brained." Montaigne was one of the first exponents of the so-called stream of consciousness and of course part of what makes him so engaging is following that stream around bends, over rapids and through deep pools. Montaigne would scarcely be considered the father of the essay, let alone one of the great writers of the western tradition, if he were merely scatter-brained. Much more recent writers, notably Virginia Woolf and James Joyce, made use of the stream of consciousness. They are not normally accused of being scatter-brained.

Incidentally, it is becoming more common for scholars who want to appeal to a broad audience to put notes at the end of the book, listed by page number, without printing the corresponding numbers in the text. I do not agree that the notes are therefore useless. This practice simultaneously meets the needs of students and scholars, who want the notes, and of general readers who hate being distracted by them. William Lee Miller, a distinguished historian at the University of Virginia, handles his notes in the same way in his excellent study of Lincoln, "President Lincoln: The Duty of a Statesman."

Good for some purposes

Very helpful if you are looking for places to stay and to eat in major population areas.. Not so helpful regarding smaller towns or general information about the things to see and do.

Not their best effort

Disappointed. We are travelling in China for a month and have been using the Lonely Planet China for that trip. We are able to plan every facet of the trip with the book. Specifically - how to actually get places (the most important part of traveling if you ask me). Unfortunately for the second month of travel in SEA, this is not possible with the LP VCLNT copy we received just before we left home (too bad we left the old version at home expecting the updated version to be more useful). The book has good information about places to stay and eating (as well as tips like "be nice to locals" or "don't hurt the environment") but not as much information about how to get from point A to point B. So far I am constantly online trying to deduce the best route from Bangkok to Siem Reap to HCMC to Hanoi etc. In the China one it lays out on point transportation options for the common next destinations. This book does not do a very good job of laying out transport options between these countries - surprising as they encourage you to travel through each in the Plan Your Trip Section. Basically it says to fly. Where is the adventure in that?
Finally, I also don't understand the need to put reviews of five star hotels in these books. How difficult would it be to print two identical versions of the same book - one for normal travelers and one for those with no budget? Maybe take out the low end transportation tips for the latter as well. Lots of wasted print. Not their best effort.
Overall, I first used LP for a long trip through Asia 12 years ago and in my opinion the product (in this case) has devolved into too many feel good tips and high end options and not enough useful data. Get back to basics boys and girls.

This Book Will Keep You From Finding The Good Stuff

So I went on a long trip around SE Asia which included many countries in the area. I was thrilled when I found out that these books were on Kindle. I figured I could download the books instead of carrying a heavy book with the limited space in my pack, and I was going to need a lot of books. For starters, the Kindle books are worthless. Instead of having more information, because they don't have to use more paper, there is less information. In fact, so little that it looks like they put these books together in such a hurry just to get by so they could throw them out there. The formatting is outrageous. Even the worst Kindle books have clickable links so you don't have to scroll back and forth, back and forth, from the index. I asked Amazon for a refund and had them delete the worthless excuse for a publication.
Next, most all of the information in all the different countries' books I looked at in bookstores and from other travelers was way out of date, and these are new books. The worst problem is that there is so little information as to make these books a complete waste of owning. All the great places I stayed at, and everybody else easily found as well, are not in their books. Following Lonely Planet guides actually keeps you from finding all the best places to stay, because you are relying on out of date, poorly researched information. They will tell you things like this is the place all the backpackers go and is the best value, and it will be completely wrong. I went to one place they gave a great review in a new book, and it seemed like a filthy drug den with gangsters running it. The new owners of Lonely Planet have taken the good name of the Wheelers and their past accomplishments, and are milking it for all it's worth without putting in the work.
Here is what I suggest. Go to Google maps to look at the cities or places where you plan to go. Even the smallest places like Don Khon, or Thakhek, in Laos, or Cambodia, or wherever, will have hotels listed on Agoda, or Booking.com, or some other site, for example. Just Google the place name and hotels. You will also see other places listed on Google map which have links to reviews, with up to date listings and prices. You will also see where the concentrations of places to stay are in a town, that might not have a link, and then you simply go there and look around. I wouldn't be surprised if this is the way Lonely Planet was getting a lot it's limited information, because in everything I read, it seemed that they had never visited any of the limited places they cover, and when I say limited, I mean limited. How they can have the guts to print out new editions with less information than the previous ones is beyond me. My fifteen-year-old edition of India, for example, had more maps than the new book. Anyway, you don't need maps in a book anymore. Everything you need to know is up on the web and current and the smallest villages have internet access.
I would look at fellow traveler's books in disbelief. The people carrying them said they were almost useless. It was a common topic of conversation. Everyone said they would be no longer buying these. One guy joked about feeding it to the cows that commonly eat paper out of the trash in India. Seriously, they would be more useful with blank pages so you can write in your own info, or that from other travelers. Don't waste your money or be disrespected by these slackers, whom I wouldn't be surprised have never travelled farther than from their computers to the coffee machine.

About the Author
Prior to her near-death or near-death-like experience, Sandy had been heavily involved with church and children's activities since she became pregnant with her first child. She was a Sunday School teacher, Youth Leader and director of Christmas and Easter Pageants. She worked for the school system as a payroll clerk, SIMS manager and substitute teacher. Sandy volunteered for Hospice and many other organizations to uplift those in need. Currently, Sandy is on the Board of Directors for ACISTE (American Center for the Integration of Spiritually Transformative Experiences), www.aciste.org. She is also a forum administrator for ACISTE Experiencer Forum, which is a social network site for experiencers only. It is a place to share and discuss our experiences, challenges, gifts, missions or thoughts in a supportive, validating community of other experiencers. The idea is to make new friends as we help each other process our spiritually transformative experiences. Sandy also assists other forums such as: NDE-Space, ASCSI, and NHNE. She is a member of IANDS (International Association for Near-Death Studies, and co-leads the Triad Iands Support Group. She is married with two grown children and one grandchild.

Wonderful read, thought provoking, inspirational and a must read for anyone interested in spiritual experiences.

Sandy Briggs has brought us a book that has been well researched through the years of her spiritual journey. It began for her as a child and has continued through her adult years. She has reached out to others with similar experiences to get a better understanding of all she has experienced.
While I have not had any spiritual interactions of my own, I have family members that have. It gave me a better understanding of what I have been told over the years.
This book offers much insight into Mrs. Briggs life journey and how this has given her an inner peace to get through obstacles that we all face. Thank you for writing this book, Mrs. Briggs, it has also, given me a better understanding of my own life and daily struggles as well.

Beautifully Rich and Amazing Journey in the Light of God

Sandy Briggs takes you on a wonderful and inspiring journey into her transformational experiences of God - from the depression that first plagued her to the loving joyful experience of God that set her soul free and on a path of mission.

The Scriptures which Sandy shares here and there in her book I experienced in a whole new way. They came alive for me. My experience of them were not as words being preached at you, but rather as rose petals that open, blossoming and spreading their fragrance, taking on a whole new meaning for me.

This book is very well-written and flows very easily. I was really drawn into her story of her experiences of God and had many, "Aha!," moments along the way for myself. This is a book I know I will read again and will refer to often.

To date, there have been two books on Near-Death Experiences that have deeply touched my life. One is Anita Moorjani's, "Dying to be Me", the other is Barbara Harris Whitfield's, "Full Circle: The Near-Death Experience and Beyond." Sandy Briggs' book, "A God Experience In the Light: A Transcendent Experience of the Spirit" has now been added to my special list. I am looking forward to reading her next book.

Lessons of Tolerance and Love

A God Experience in the Light describes a number of interesting, transcendent experiences. But more than a typical NDE book, Ms. Briggs adds a number of important lessons of love, including the importance of sticking with difficult choices to accomplish personal mission, even if it means sacrificing immediate happiness. Ms. Brigg's also challenges the foundations of conservative Christianity. As a Christian feeling rejected by other Christians following her NDE-like experience, Ms. Briggs effectively contrasts the narrow, intolerant attitudes of some corners of Christianity with the open, tolerant ministry of Jesus. I likewise share her concerns with the general direction of Christianity; somehow it seems that the conservative movement has hijacked Jesus to create an exclusive, judgmental club that does not reflect the loving Spirit of Christ. I also liked her discussion of pre-birth memories. Ms. Briggs writes in an easy but intelligent style. I highly recommend this book that stand's apart from the rest.
